A German player who lost $26,000 dollars in a online casino games has been told by a judge that he must get this money back from the casino in question. The reason why the player could claim back his lost money from the online casino is that the company mistakenly offered online casino games to players in Frankfurt. While online gambling of the time was not legal. The casino is therefore tapped on the fingers and the player has to pay back the 26 thousand dollars.
That the player lost $26,000 in a span of 2 years. From January 2018 to February 2020. However, Online gambling has only been allowed in the Frankfurt region since July 2021. The court thus ruled that the online casino wrongly casino games such as live roulette and casinoslots offered to German player in this region. Thus, the player who lost the amount of 26 thousand dollars has the right to demand back from the casino his (wrongly) lost money. “Because with its offer the operator has violated the Prohibition of online gambling in accordance with Section 4 (4) of the state convention on gambling, they obtained the bet without any legal reason,” explains the player's lawyer, István Cocron. "That is why we have demanded that our customers receive full compensation for the damage.”
Referring to the player who violated the State Treaty on gambling, the Frankfurt court said that it cannot be certain that the player was aware of the ban on online gambling, nor that he violated the rules set out in the Treaty.
That a player gets his losses back for the reasons mentioned earlier is not unique. In recent years, there have been more such statements where players have received their lost money back. In March, a player received more than $25,000 back from an online casino because it offered casino activities to a player while this was not yet allowed in the state of North Rhine-Westphalia.
